ACCEPTANCE OF WORK: By signing or digitally approving via email this Estimate/Invoice, you (“Customer”) agree that the prices, specifications, and conditions are satisfactory on this Estimate/Invoice and that you accept (as a binding “Contract”) the Estimate and the Terms & Conditions. You are authorizing Parish Restoration LLC (“PR”) to do the work as specified, and payment will be made as outlined in this Estimate/Invoice. Payment in full is due once a job has been completed. Deposits are non-refundable unless PR is not able to perform the work specified. Estimates are valid for 30 days.
CUSTOMER RESPONSIBILITY: All doors must be accessible prior to the scheduled time of treatment. High-value or priceless items should be made known to PR in advance of treatment to ensure proper care and handling. All areas must be vacant prior to the start of treatment, during the treatment, and remain unoccupied for up to 2 hours after treatment concludes (including pets). If the property is equipped with a fire detection system that reports to a central monitoring service, the central monitoring service must be informed not to dispatch the fire department during the fogging treatment. The original source of dampness (water leak, roof leak, flooding, high moisture, etc.) must be completely handled prior to treatment. If not handled, PR is not liable for any mold growing back.
TREATMENT OVERVIEW: All cabinet doors, drawers, and dishwashers will be opened to allow the fog to penetrate those spaces. All doors and access must be open before the scheduled time of treatment.
- Treatment #1: SaniDate Dry Fog Treatment utilizes a hospital-grade disinfectant effective in eliminating mold, bacteria, and other pathogens.
- Treatment #2: Goldshield Dry Fog Treatment is an antimicrobial that creates a protective barrier on all surfaces, creating a hostile environment and limiting the ability for future growth. Both Dry Fog treatments are non-toxic and safe, with a slight vinegar-like smell that will dissipate over the next 24 to 48 hours.
TREATMENT DOES NOT INCLUDE: Any fees related to the repairs associated with the original source of water intrusion or dampness.
PROVISIONS/CANCELLATIONS: All contracts must be approved and signed prior to scheduling the remediation job. PR will set your planned service date(s) once the deposit has been given, and PR will do its best to keep to that schedule. If you need to reschedule for any reason, 72 hours advance notice must be given to PR in writing or customers may be subject to a $200 change-order fee. If you wish to cancel for any reason, 72 hours advance notice must be given to PR in writing or 30% of the original deposit will be retained as an inconvenience fee. If the required work turns out to be significantly different than what was stated in the contract, the remediation project will be put on hold until the work plan has been adjusted and a revised Estimate/Invoice is approved by the Customer. If the worksite is found by PR to be dangerous or hazardous, the work may or may not be performed until safer working conditions are established.
LICENSING & COMPLIANCE: Parish Restoration, LLC operates in compliance with all applicable Louisiana state requirements. Contractor licenses held: Mold Remediation (MR.251143), Building Construction (CL.76340), Residential Construction (RL.889286). Work performed under this Agreement shall conform to these licensing requirements.
Warranty
RESIDENTIAL: PR dry fog services are guaranteed for a period of 1 year from the treatment date. The two-step process of SaniDate & Goldshield dry fog must be completed. If at any time during that 1-year follow-on period, viable mold is found (at a greater density than the outside air) in the area of service, PR will re-treat the home at no additional charge. WARRANTY IS VOID if additional water has been introduced into the premises (i.e., groundwater intrusion, broken pipe, appliance leak, roof leak, 60% or higher humidity levels, etc.) or if the original source of dampness was not handled prior to doing the treatment. Removal of non-viable mold is not covered under the warranty.
COMMERCIAL: Mold Services are guaranteed for a period of 3 months from the treatment date, but only when the entire building is treated with SaniDate and Goldshield. If at any time during that 3-month follow-on period, viable mold is found (at a greater density than the outside air) in the area of service, PR will re-treat the building at no additional charge. WARRANTY IS VOID if additional water has been introduced into the premises (i.e., groundwater intrusion, broken pipe, appliance leak, roof leak, 60% or higher humidity levels, etc.) or if the original source of dampness was not handled prior to doing the treatment. Removal of non-viable mold is not covered under the warranty.
LEGAL LIMITATIONS / REMEDIES: PR SPECIFICALLY DISCLAIMS ANY AND ALL OTHER WARRANTIES BEYOND THOSE LISTED ABOVE AND ALL IMPLIED WARRANTIES (EITHER IN FACT OR BY OPERATION OF LAW) INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR ANY IMPLIED WARRANTY ARISING OUT OF A COURSE OF DEALING, CUSTOM OR USAGE OF TRADE.
PR’s performance of services is limited by, among other things, the pre-existing conditions and characteristics of the premises, material, fabrics, furniture, and/or other items. PR EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR ANY PRE-EXISTING CONDITIONS. Customer shall retain responsibility and shall be liable for all effects of and costs necessary to correct such conditions. IN NO EVENT SHALL PR, ITS OWNERS, ANY OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE RESPONSIBLE FOR INDIRECT, SPECIAL, NOMINAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL LOSSES OR DAMAGES, OR FOR ANY PENALTIES, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY ASSERTED, INCLUDING CONTRACT, NEGLIGENCE, WARRANTY, STRICT LIABILITY, STATUTE OR OTHERWISE, EVEN IF IT HAD BEEN AWARE OF THE POSSIBILITY OF SUCH DAMAGES OR THEY ARE FORESEEABLE; OR FOR CLAIMS BY A THIRD PARTY.
Customer acknowledges and agrees that limited photographs or video of the damage and cause may be made solely for work process, PR’s internal records, and insurance claims purposes.
Any claim by Customer for faulty performance, for nonperformance or breach under this Contract for damages shall be made in writing to PR within sixty (60) days after completion of services. Failure to make such a written claim for any matter which could have been corrected by PR shall be deemed a waiver by the Customer. NO ACTION, REGARDLESS OF FORM, RELATING TO THE SUBJECT MATTER OF THIS CONTRACT MAY BE BROUGHT MORE THAN ONE (1) YEAR AFTER THE CLAIMING PARTY KNEW OR SHOULD HAVE KNOWN OF THE CAUSE OF ACTION.
CUSTOMER AND PR EACH WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY WITH RESPECT TO ANY AND ALL CLAIMS OR CAUSES OF ACTION (INCLUDING COUNTERCLAIMS) RELATED TO OR ARISING OUT OF OR IN ANY WAY CONNECTED TO THIS CONTRACT AND AGREE THAT ANY CLAIM OR CAUSE OF ACTION WILL BE TRIED BY A COURT TRIAL WITHOUT A JURY. If any provision of this Contract is found to be ineffective, unenforceable or illegal for any reason under present or future laws, such provision shall be fully severable, and this Contract shall be construed and enforced as if such provision never comprised a part of this Contract. The remaining provisions of this Contract shall remain in full force and effect and shall not be affected by the ineffective, unenforceable or illegal provision or by its severance from this Contract.
A failure of either party to exercise any right provided for herein shall not be deemed to be a waiver of any right hereunder.
